NS Machine - Terms

Terms: New machinery Net 30 days. Used machinery Net Cash. Interest will be charged for all accounts past 30 days from invoice date at maximum rate allowable by law. All machines are offered subject to prior sale and prices quoted are exclusive of any government sales tax. Machinery descriptions are intended only as a guide and their accuracy is not guaranteed. All prices listed are in U.S. Dollars unless otherwise specified in writing.
Conditions: Machinery should be inspected by buyer. Quotations are subject to change without notice. All agreements cotingent upon strikes, fires, accidents, delay of carriers and other delays unavoidable or beyond our control and all agreements and/or contracts made by salesmen or representatives are subject to approval by N.S. Machine Corporation. Machines are offered "as is" unless otherwise stated to be specified in our offering and acknowledged in customer's purchase order.
Machine Safety: It is the user's responsibility to provide proper safety devices and equipment to safeguard the operator from harm for any particular use, operation or set-up, and to adequately safeguard the machine, or machines to conform to all, Federal, State and Local Government Safety Standards and all Industrial Safety Standards.
Indemnification: User agrees to indemnify and hold harmless Seller of and from any and all claims or liabilities from accidents involving these machines caused by failure of user, his employees, or agents to follow instructions, warnings, or recommendations furnished by manufacturer, or Seller, or by failure of user to comply with Federal, State, and Local laws applicable to such equipment including the Occupational Safety and Health Act of 1970. User shall notify Seller promptly of any accident involving these machines and in any event within 30 days after the occurence, and shall cooperate fully with Seller, or Seller's agent in investigating and determining the cause of said accident.
Return Priviledge: There are no warranties express or implied, including warranties of merchantability and fitness for purpose, made by Seller in connection with this sale except as expressly set forth herein. Seller will accept within 30 days from shipment of machinery and equipment with a return priviledge, freight prepaid for refund of the purchase price if proven mechanically unsatisfactory, or will repair same at Seller's option. this does not apply to machines sold directly from auctions, private user's plants, other Dealers' inventories, unless specifically arranged in writing, or re-negotiated sale at a lesser price. This return privilege will be null and void if the Buyer attempts to service or repair machinery without the prior written consent of the Seller.
